User information registered on the platform applies.
ARTICLE 2 - SUBJECT
The subject of this agreement is the sale and delivery of subscription services purchased online by the BUYER from the SELLER's 3DCloud platform, and determination of the rights and obligations of the parties.
ARTICLE 3 - SERVICE DESCRIPTION
Features of the purchased service:
- Service type: 3D Model Hosting and Embed Service
- Package name and features: Determined by the package selected at order time
- Sales price: Amount including VAT shown at order time
- Payment method: Credit card / Debit card
ARTICLE 4 - GENERAL PROVISIONS
4.1. The BUYER accepts that they have read and are informed about all information regarding the basic features, sales price, payment method, and delivery conditions of the service purchased, and have given the necessary confirmation electronically.
4.2. The service is activated immediately after payment approval.
4.3. The SELLER undertakes to provide the service completely and in accordance with the specifications stated in the order.
ARTICLE 5 - RIGHT OF WITHDRAWAL
IMPORTANT NOTICE: RIGHT OF WITHDRAWAL FOR DIGITAL SERVICES
Pursuant to Turkish Consumer Protection Law No. 6502 and Distance Contracts Regulation Article 15(ğ):
"The right of withdrawal cannot be exercised in contracts for services that are instantly performed electronically or for intangible goods that are instantly delivered to the consumer."
3DCloud subscription services are digital services that are activated instantly after payment approval. Therefore:
- There is no right of withdrawal for purchased subscriptions.
- Refunds are not provided.
- The BUYER makes the purchase accepting this condition.
ARTICLE 6 - SUBSCRIPTION PERIOD AND RENEWAL
6.1. 3DCloud offers annual subscription plans only.
6.2. Subscriptions do not auto-renew. The BUYER must manually renew their subscription when the annual period ends.
6.3. Renewal can be made before the subscription period expires.
6.4. Even if cancellation is requested during the subscription period, no partial refund is provided for the remaining time. The service remains active until the end of the year.
ARTICLE 7 - PAYMENT AND DELIVERY
7.1. Payments are processed through secure payment infrastructure (PayNKolay).
7.2. Credit card information is not stored by the SELLER.
7.3. The service is activated immediately after payment confirmation.
7.4. Invoice is sent to the BUYER's registered email address.
ARTICLE 8 - BUYER'S OBLIGATIONS
- Comply with terms of use
- Upload legal content
- Ensure account security
- Make payments on time
ARTICLE 9 - SELLER'S OBLIGATIONS
- Make maximum effort to provide uninterrupted service
- Store BUYER data securely
- Provide technical support
- Notify important changes in advance
ARTICLE 10 - DISPUTE RESOLUTION
Laws of the Republic of Turkey apply to disputes arising from this agreement. Istanbul Courts and Enforcement Offices have jurisdiction.
ARTICLE 11 - EFFECTIVENESS
This agreement enters into force on the date it is approved electronically by the BUYER.
The BUYER declares that they have read, understood, and accepted all articles of this agreement.
